JAKARTA - Pengadilan Tata Usaha Negara (PTUN) Jakarta hari ini akan mengeluarkan putusan mengenai digitalisasi yang diajukan oleh Asosiasi Televisi Jaringan Indonesia (ATVJI).

Sidang dijadwalkan akan digelar pukul 10.00 WIB. Kuasa hukum ATVJI, Andi Simangunsong, optimis majelis hakim akan mengabulkan gugatan yang dilayangkannya. Sebab, sebelumnya Mahkamah Agung (MA) telah mengabulkan permohonan ATVJI yaitu membatalkan Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011 tentang penyelenggaraan tv digital.

"Kami optimis, ini lagi nunggu sidang dimulai. Menurut kami pemenang tender kanal tv digital itu bertentangan, karena peraturan menteri telah dibatalkan oleh MA. Jadi menurut kami seharusnya gugatan ini dikabulkan," ujar Andi kepada Okezone, Kamis (5/3/2015).

Andi mengatakan, jika industri televisi akan ke arah digital maka peraturan harus jelas dan sesuai dengan tatanan, yaitu dengan merevisi undang-undang penyiaran dan bukan dengan menerabas peraturan menteri

"Menghidupkan tv digital harus di undang-undang bukan di peraturan menteri," ujarnya.

Sebelumnya, MA membatalkan Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011, sebagaimana gugatan ATVJI. Putusan dengan nomor perkara 38 P/HUM/2012 itu diadili oleh Ketua Majelis Hakim Imam Soebchi dengan hakim anggota Supandi dan Harry Djatmiko. Putusan diketuk palu pada 3 April 2013.
