JAKARTA - Menteri Komunikasi dan Informatika Rudiantara mengatakan belum memutuskan akan mengajukan permohonan banding atau tidak atas pembatalan Peraturan Menteri tentang Penyelenggaraan Televisi Digital oleh Pengadilan Tata Usaha Negara. "Saya belum menerima salinan putusan," ujar Rudi kemarin.

Rudi menilai putusan PTUN akan berimbas pada multiplexing yang sudah berinvestasi. Namun ia mengaku belum tahu siapa saja dan berapa banyak kerugiannya.

Selain memikirkan upaya banding, menurut Rudi, langkah lain yang akan diambil pemerintah adalah mengajukan revisi Undang-Undang Penyiaran ke DPR RI agar digitalisasi televisi dapat berjalan. Revisi undang-undang itu akan mengatur digitalisasi TV sehingga dasar hukumnya kuat. "Sudah masuk prolegnas (program legislasi nasional) tahun ini," kata dia.

Pemerintah menargetkan digitalisasi televisi pada 2018. Saat itu, seluruh televisi analog harus sudah switch off dan pindah ke digital. Rudi menilai langkah tersebut dilakukan guna mengatur frekuensi yang dapat dimanfaatkan untuk perkembangan komunikasi yang lancar, terutama bagi pengguna smartphone.

Staf ahli bidang komunikasi dan media massa Kementerian Komunikasi dan Informatika, Henry Subiakto, mengatakan putusan PTUN membuat program digitalisasi televisi terancam molor. Ia berharap DPR segera membahas RUU Penyiaran. "Semoga pembahasan tidak alot sehingga RUU ini bisa cepat disahkan," ujar dia.

Menurut dia, masyarakat sangat bergantung pada kebutuhan bandwidth atau frekuensi untuk dapat berkomunikasi melalui smartphone. Namun, kata dia, menurut penelitian Kementerian, tahun ini hingga 2020 Indonesia defisit frekuensi sebanyak 500 MHz.

Defisit itu terjadi karena pertumbuhan pengguna dan aplikasi smartphone yang melonjak tinggi, hingga 60 persen. "Semua orang butuh frekuensi sehingga ini harus ditata ulang. Kalau tidak ditata, yang akan terjadi smartphone kita akan sangat lemot," kata dia. Sementara kalau migrasi ini berhasil dan TV analog off maka bisa dikelola frekuensi tambahan 800 MHz, yang cukup untuk untuk kebutuhan broadband hingga 2025.

Pekan lalu, majelis hakim Pengadilan Tata Usaha Negara mengabulkan gugatan Asosiasi Televisi Jaringan Indonesia (ATVJI) terhadap Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011 tentang Penyelenggaraan Televisi Digital. Asosiasi meminta pembatalan peraturan yang menyebutkan TV analog harus bermigrasi ke TV digital melalui sistem multiplexing dengan membayar sewa.

"Ini mengebiri hak Lembaga Penyiaran Swasta (LPS) dalam menggunakan frekuensi dan menyiarkan konten," ujar kuasa hukum ATVJI, Andi Simangunsong, kepada Tempo kemarin. Menurut dia, dasar hukum aturan digitalisasi tersebut lemah karena hanya diatur dalam peraturan menteri. "Perubahan ke digital itu, menurut Mahkamah Agung, harus diatur undang-undang."

Sebelumnya, Menteri Komunikasi dan Informatika Kabinet Indonesia Bersatu II, Tifatul Sembiring, mengeluarkan Per-aturan Nomor 22/PER/M.KOMINFO/11/2011 tentang Penyelenggaraan Penyiaran Televisi Digital Terestrial Penerimaan Tetap Tidak Berbayar (free to air). Tifatul dengan peraturan itu menunjuk 33 perusahaan sebagai pemenang lembaga multiplexing di Indonesia.

Namun, pada 3 April 2013, Mahkamah Agung membatalkan peraturan menteri tersebut melalui Keputusan Nomor 38 P/HUM/2012 dan Keputusan Nomor 40 P/HUM/2012. MA menilai peraturan Menteri Komunikasi dan Informatika bertentangan dengan Undang-Undang Penyiaran dan Peraturan Pemerintah Nomor 50/2005 tentang Penyelenggaraan Penyiaran Lembaga Penyiaran Swasta.

Meski telah dibatalkan Mahkamah, pemerintah tetap berkeras menjalankan peraturan tersebut. Tindakan ini membuat ATVJI dan ATVLI (Asosiasi Televisi Lokal Indonesia) mengajukan gugatan lagi ke PTUN untuk membatalkan keputusan tersebut.

Menurut Andi, amar putusan PTUN menyatakan pembatalan dan penundaan terhadap seluruh izin penyiaran digital. "Sampai dengan inkracht aturan digital ini tidak bisa dijalankan," kata Andi. Televisi yang tetap melakukan siaran digital terancam dipidanakan.

Aturan tersebut, kata Andi, merugikan LPS yang telah berinvestasi miliaran rupiah untuk siaran dengan frekuensi sendiri. Jika aturan digitalisasi diberlakukan, semua LPS akan merugi besar. "Belum ditambah lagi sistem sewa multiplexing," kata dia.

Dalam sistem multiplexing satu provider hanya boleh diisi 9-12 kanal TV, sehingga, kata Andi, kesempatan untuk mendapatkan siaran terbilang kecil karena harus berbersaing dengan banyak TV analog. Kalau gagal, mereka hanya jadi penyedia konten.
