Jakarta - Gugatan terhadap Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011 tentang penyelenggaraan TV digital dikabulkan oleh Ketua Majelis Hakim (KMH) PTUN Jakarta.

Dalam gugatan tersebut, Asosiasi Televisi Jaringan Indonesia (ATJVI) meminta pembatalan dari peraturan yang dimaksud. Menanggapi hal itu, Menkominfo Rudiantara mengaku belum mendapat salinan dari putusan pengadilan tersebut.

"Belum, saya belum dapat salinannya. Saya juga baru dikabari kemarin (5/3/2015) petang," ujar Rudiantara di Jakarta, Jumat (6/3/2015).

Dia juga mengatakan, saat ini masih ada waktu untuk naik banding terhadap putusan tersebut. Putusan akan dikeluarkan setelah pihaknya mendapatkan salinan gugatan.

"Banding atau tidak itu juga nanti, setelah saya dapat salinannya. Ya kan sebelumnya sudah sepakat, UU ini sudah masuk ke dalam prolegnas yang dibahas tahun 2015 ini," tambahnya.

Namun yang harus diperhatikan, menurut menteri yang akrab disapa Chief RA ini, adalah pihak-pihak seperti lembaga penyiaran yang akan terkena dampak dari putusan ini.

"Harus diperhatikan perusahaan-perusahaan penyiaran yang sudah terlanjur berinvestasi, mereka kan harus dilindungi. Jadi intinya, kita harus baca dulu putusannya. Apakah itu menggugurkan permen yang lama, izinnya dicabut dan diganti izin yang baru atau bagaimana," sebutnya.

Digital TV ministerial regulation Canceled, MCIT Appeal?

Jakarta - The lawsuit against the Minister of Communication and Information Technology Number 22 Year 2011 concerning the implementation of digital TV is granted by the Chief Justice (KMH) Jakarta Administrative Court.

In the lawsuit, the Association of Indonesian Television Network (ATJVI) requesting the cancellation of the regulations in question. In response, the Minister of Communication Rudiantara claimed to have received a copy of the court decision.

"Not yet, I have not been able to copy. I also just informed yesterday (03/05/2015) evening," said Rudiantara in Jakarta, Friday (06/03/2015).

He also said that currently there is still time to appeal against the verdict. The verdict will be issued after it got a copy of the lawsuit.

"Appeal or not it also later, after I was able to copy. Yes the previously been agreed, this Act has been entered into the national legislation in 2015 that discussed this," he added.

But that must be considered, according to the chief minister who was familiarly called this RA, are parties such as broadcasters who will be affected by this decision.

"It should be noted that broadcasting companies are already investing, their right to be protected. So basically, we have to read the first sentence. Does that invalidate the old ministerial regulation, registration revoked and replaced by a new license or how," he said.
