Jakarta - Kementerian Komunikasi dan Informatika (Kominfo) memastikan bakal mengajukan banding atas hasil putusan Pengadilan Tata Usaha Negara (PTUN) yang menggugurkan Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011 tentang Penyelenggaraan TV Digital.

Demikian ditegaskan Kepala Pusat Informasi dan Humas Kementerian Kominfo Ismail Cawidu kepada media, Rabu (18/3/2015).

"Terkait dengan putusan PTUN tanggal 5 Maret 2015 yang membatalkan 33 Kepmen tentang lembaga multiplexing MUX di 11 provinsi maka setelah mempelajari dan mempertimbangkan secara seksama, Kemkominfo menempuh upaya banding terhadap keputusan PTUN dimaksud," jelas Ismail.

Kominfo beralasan, pertimbangan tersebut dimaksudkan untuk memastikan industri penyiaran dan masyarakat tetap mengarah kepada proses migrasi analog ke digital.

"Sikap Kemkominfo adalah melakukan rancang ulang (redesign) terhadap penyelenggara muktiplexer yang bersifat independen dan efisien untuk penyelenggaraan televisi digital," papar Ismail.

"Juga untuk tetap terjaminnya pelaksanaan program pita lebar Indonesia dengan optimalisasi digital deviden," lanjutnya.

Setelah memutuskan untuk banding, Kominfo selanjutnya bakal menyusun memori bandingnya. "Waktunya kan 2 bulan, kita harapkan bisa berjalan sesuai rencana," Ismail menandaskan.

Sebelumnya, PTUN Jakarta telah mengabulkan gugatan dari Asosiasi Televisi Jaringan Indonesia (ATJVI) atas Peraturan Menteri Komunikasi dan Informatika Nomor 22 Tahun 2011 tentang Penyelenggaraan TV Digital.

Ada empat keputusan dalam perkara No.119/G/2014/PTUN-JKT yang dibacakan oleh Ketua Majelis Hakim. Pertama, menolak eksepsi tergugat dan tergugat intervensi seluruhnya. Kedua, menyatakan batal segala peraturan menteri mengenai aturan penyiaran digital. Ketiga, mewajibkan tergugat untuk mencabut keputusan menteri tentang penetapan aturan penyiaran digital. Keempat, menghukum tergugat dan tergugat intervensi 1 sampai dengan 29 untuk membayar perkara sebesar Rp 1.382.000.

Ambisi TV Digital

Menkominfo Rudiantara sendiri sebelumnya begitu menggebu-gebu untuk mendorong implementasi TV digital. Bahkan pada akhir 2015, Kominfo siap merilis kebijakan baru terkait siaran digital agar spektrum frekuensi di 700 MHz bisa segera dimanfaatkan untuk mobile broadband seperti 4G LTE.

"Akhir tahun ini kita keluarkan beleid yang isinya firm kita mulai 1 Januari tahun kapan sudah harus pindah ke digital," ungkap Rudiantara beberapa waktu lalu.

Beleid ini, kata menteri yang akrab disapa dengan panggilan Chief RA, akan memberikan kepastian bagi para pemilik lisensi multiplexer. Selain itu, jika frekuensi 700 MHz bisa segera dialihkan untuk layanan mobile broadband, manfaatnya akan lebih optimal bagi perekonomian Indonesia.

Seperti diketahui, spektrum frekuensi di 700 MHz telah lama dianggap sebagai frekuensi emas oleh operator untuk menggelar 4G LTE selain 1.800 MHz. Alasannya, karena spektrum ini memiliki coverage band lebih luas.

Di Indonesia, frekuensi 700 MHz masih digunakan untuk siaran televisi analog. Pemerintah melakukan program digitalisasi televisi, yang nantinya akan menghapus televisi analog. Program ini mulanya ditargetkan akan selesai paling cepat di akhir 2017.

Dari program digitalisasi televisi itu, nanti frekuensi 700 MHz akan memiliki digital dividend sebesar 112 MHz. Rentang pita sebesar 112 MHz di frekuensi 700 MHz itulah yang nantinya akan digunakan untuk alokasi jaringan 4G LTE di Indonesia.

Dalam kajian The Boston Consulting Group harmonisasi frekuensi 700 MHz di Indonesia setelah 2018 menyebabkan kerugian sebesar USD 16,9 miliar untuk GDP, USD 4,7 miliar untuk pajak, 79.000 usaha dan 152.000 lowongan kerja.

"Digitalisasi dari televisi itu suatu keniscayaan karena izin multiplexing sudah (pernah) dikeluarkan. Nanti kita bicarakan lagi dengan industri dan pemilik TV agar bisa keluarkan peraturan (baru)," kata Chief RA.

"Nanti produksi analog disetop, tapi masyarakat juga harus bisa nikmati digital.Nah, itu disubsidi dengan set top box. Ada 8 juta yang disediakan oleh para pemilik multiplexer. Kalau sekarang belum, masalahnya mau dikasih ke siapa," pungkas menteri.

Previously, Jakarta Administrative Court in favor of the Association of Indonesian Television Network (ATJVI) on the Regulation of the Minister of Communication and Information Technology Number 22 Year 2011 on the Implementation of Digital TV.

There are four decision in case 119 / G / 2014 / PTUN-JKT which was read by the Chief Justice. First, the defendant and the defendant's demurrer reject entirely intervention. Third, requiring the defendant to revoke a ministerial decree on the establishment of digital broadcasting rules. Digital TV ambitions

MCIT Rudiantara own before so eager to encourage the implementation of digital TV.
